A man who severely injured his toe after going into Lake Berryessa during the summer of 2016 is suing Pleasure Cove Marina alleging that the resort’s negligence caused his injury.
Robert Trieber says that he sliced his right big toe open on a steel cable that was in the lake near the resort on June 18, 2016, according to the suit filed in Napa County Superior Court last month. The injury prompted heavy bleeding and severed Trieber’s nerve, causing permanent damage, the suit alleges. Trieber was at the resort as a “business invitee,” according to the suit.
Neither representatives from Pleasure Cove Marina L.L.C. nor Trieber’s attorney, by K. Douglas Atkinson of Atkinson & Associates in San Francisco, were available for comment.
Trieber is asking for general damages, medical and related expenses, pre- and post-judgment interest, the costs of suit and other economic damages as well as a trial by jury.
A case management conference is scheduled for May 29.
